Sexual Assault
Sexual assault is considered a violent and serious crime in Colorado, and as with other crimes, there are varying degrees and classifications for sexual assault. Felony sexual assault not only carries possible penalties of up to life in prison, but also is a very heavily regulated crime that requires registration as a sex offender, possible probation for the rest of life, periodic polygraph testing and other testing, and so on. There are many different categories of sexual assault, including the following:
- Sexual assault
- Unlawful sexual contact
- Sexual assault on a child
- Sexual assault on a child by a person in a position of trust
- Sexual assault on a client by a psychotherapist
When convicted in any of these categories, the person must thereafter be registered as a sex offender. Felony sexual assault charges may be based upon allegations that the sexual contact was the following:
- Committed with force
- Committed against the person's will
- Committed when the victim is not capable of giving consent (such as 17 years or younger or mentally retarded)
Sexual assault may range from more extreme assault involving actual penetration to a less extreme assault such as touching the person's private body parts for sexual gratification.
Because a mere accusation of sexual assault—let alone a conviction, which is life-altering—can be very damaging to a person's reputation, it is essential to obtain competent and experienced legal counsel right away. A pivotal factor in determining innocence may be proving that the sexual encounter was consensual or that allegations of sexual assault were based on revenge or other motivation.
